Terms and Conditions

These Terms and Conditions govern use of the Top 100 Leaders website and participation in the Top 100 Leaders nomination and recognition program.

Top 100 Leaders is an initiative of Empowering People In Construction Pty Ltd ("EPIC", "Top 100 Leaders", "we", "us" or "our").

By accessing our website, submitting a nomination or paying a nomination fee, you agree to these Terms and Conditions.

Definitions

In these Terms:

  • Australian Consumer Law means Schedule 2 of the Competition and Consumer Act 2010 (Cth).
  • Nomination means an application submitted for consideration under the Top 100 Leaders recognition program.
  • Nomination Fee means the fee payable for the administration and assessment of one Nomination.
  • Nominee means the person who is the subject of a Nomination.
  • Nominator means the person submitting the Nomination.
  • Program means the Top 100 Leaders nomination, assessment and recognition program.
  • Recognition means selection as one of the Top 100 Leaders for the applicable Program year.
  • Submission Material means any information, statements, examples, photographs, documents or other material provided as part of a Nomination.
  • Website means the Top 100 Leaders website and any associated nomination or payment pages operated on our behalf.

The Top 100 Leaders Program

Top 100 Leaders is a nomination and recognition program designed to recognise individuals demonstrating outstanding leadership within the construction industry.

Participation in the Program does not create a membership, subscription, employment relationship, partnership or ongoing entitlement to services from Top 100 Leaders.

Each Nomination will be assessed against the nomination and assessment criteria for the applicable Program year.

Top 100 Leaders may appoint judges, assessors, advisers or industry representatives to assist with the assessment and selection process.

Submission of a Nomination does not guarantee that the Nominee will be shortlisted, selected, recognised or included in the Top 100 Leaders.

Eligibility

Nominees must satisfy any eligibility requirements published by Top 100 Leaders for the relevant Program year.

A Nomination may be submitted by another person or, where permitted by the Program, by the Nominee themselves.

Top 100 Leaders may determine that a Nomination is ineligible if:

  • the eligibility requirements have not been met;
  • the Nomination is incomplete;
  • information requested by Top 100 Leaders is not provided;
  • the Nomination contains information that is materially false, misleading or unverifiable;
  • the Nomination is submitted after the applicable closing date; or
  • accepting or progressing the Nomination could reasonably compromise the integrity or reputation of the Program.

Nomination Information

The Nominator must provide information that is accurate and complete to the best of their knowledge.

By submitting a Nomination, the Nominator confirms that:

  • they genuinely believe the information provided is accurate;
  • examples and statements provided are genuine to the best of their knowledge;
  • they are not knowingly providing false, misleading, defamatory or deceptive information;
  • they are entitled to provide the information and Submission Material included in the Nomination; and
  • where information about another person is provided, it is provided for the legitimate purpose of nominating that person for the Program.

Top 100 Leaders may contact the Nominator, Nominee, their organisation or another relevant person where reasonably necessary to clarify or verify information contained in a Nomination.

Top 100 Leaders is not required to independently verify every statement contained in every Nomination.

Top 100 Leaders may exclude a Nomination or withdraw Recognition if information is subsequently discovered to have been materially false, misleading or improperly submitted.

Nomination Fee

The Nomination Fee is $125 including GST for each Nomination unless otherwise stated on the Website.

The Nomination Fee covers the administration and assessment of one Nomination.

Payment of the Nomination Fee does not guarantee selection or Recognition.

The Nomination Fee must be paid before the Nomination will be treated as complete and progressed for assessment.

Payment may be processed by a third-party payment provider, including Stripe. Use of a third-party payment provider may also be subject to that provider's terms and privacy practices.

Refunds

Because the Nomination Fee covers administrative and assessment activities that commence following submission, Nomination Fees are generally non-refundable for change of mind.

A refund will not ordinarily be provided because:

  • the Nominee is not shortlisted or selected;
  • the Nominator later wishes to withdraw the Nomination;
  • the Nominator disagrees with an assessment or selection decision; or
  • information provided in the Nomination is incomplete or does not sufficiently demonstrate the applicable assessment criteria.

Nothing in these Terms excludes any refund or other remedy to which a person is entitled under the Australian Consumer Law.

Where Top 100 Leaders cancels the Program and a Nomination will not be assessed, Top 100 Leaders will provide an appropriate refund of the Nomination Fee unless another remedy is agreed.

Where a duplicate payment or payment error occurs, please contact Top 100 Leaders so the matter can be reviewed.

Assessment and Selection

Nominations will be assessed using the criteria and assessment process established by Top 100 Leaders for the applicable Program year.

Top 100 Leaders may establish scoring methodologies, assessment guidelines and governance processes to support consistency and integrity in the selection process.

Assessors and judges may exercise professional judgement when considering the evidence provided against the assessment criteria.

Top 100 Leaders may manage actual, potential or perceived conflicts of interest involving judges or assessors in a manner it considers appropriate to protect the integrity of the Program.

Top 100 Leaders reserves the right to:

  • seek clarification or additional information;
  • determine whether a Nomination meets eligibility requirements;
  • exclude incomplete or non-compliant Nominations;
  • determine the number of people recognised;
  • resolve tied or closely scored Nominations;
  • correct administrative or assessment errors; and
  • take reasonable steps required to protect the fairness and integrity of the Program.

Assessment and selection decisions are final, subject to correction of an administrative error or any rights available under applicable law.

Top 100 Leaders is not required to provide individual scores, judging notes, rankings or detailed reasons for unsuccessful Nominations.

Recognition

A person selected as a Top 100 Leader may be contacted before or in connection with the public announcement of Recognition.

Recognition applies to the relevant Program year and does not constitute:

  • professional accreditation;
  • certification of professional competency;
  • an employment reference;
  • endorsement of every activity undertaken by the recognised person or their organisation; or
  • any guarantee regarding the person's future conduct or performance.

A recognised person may decline Recognition by notifying Top 100 Leaders.

Top 100 Leaders may withdraw or correct Recognition where reasonably necessary, including where:

  • Recognition was based on materially inaccurate or misleading information;
  • serious information comes to light that materially affects the integrity of the Recognition;
  • there has been an administrative or assessment error; or
  • continued Recognition would reasonably bring the Program into serious disrepute.

Any such decision will be made reasonably and having regard to the circumstances.

Publication and Promotion of Recognised Leaders

The purpose of the Program includes publicly recognising and celebrating selected leaders.

If a Nominee is selected, Top 100 Leaders may publish or promote information relating to their Recognition, including their name, job title or professional role, organisation, professional biography, photograph or approved image, industry experience, Recognition as a Top 100 Leader, and extracts or summaries of information demonstrating their leadership achievements.

Where practical, Top 100 Leaders may contact recognised individuals to confirm or obtain appropriate information for publication.

Recognition may be promoted through the Top 100 Leaders website, social media, digital communications, media releases, publications, promotional material and other channels connected with the Program.

Submission Material and Intellectual Property

Ownership of intellectual property in Submission Material remains with its existing owner.

By providing Submission Material, the person providing it grants Top 100 Leaders a non-exclusive, royalty-free licence to use, reproduce, adapt and communicate that material to the extent reasonably necessary to administer the Nomination, assess the Nominee, verify information, operate the Program, and where the Nominee is recognised, communicate and promote that Recognition.

The person submitting material warrants that, to the best of their knowledge, they have the right or authority to provide it for these purposes.

Submission Material must not knowingly infringe another person's intellectual property rights, breach confidentiality obligations, unlawfully disclose personal information, contain defamatory material, or otherwise breach applicable law.

Top 100 Leaders Intellectual Property

Unless otherwise stated, all intellectual property associated with Top 100 Leaders, including its name, branding, logos, Website content, nomination questions, assessment methodology and promotional material, is owned by or licensed to Top 100 Leaders.

Nothing in these Terms gives a person a right to reproduce, modify or commercially use Top 100 Leaders intellectual property without prior written permission.

Individuals who receive Recognition may be permitted to use approved Top 100 Leaders recognition graphics, badges or other materials subject to any usage guidelines issued by Top 100 Leaders.

Recognition branding must not be altered or used in a manner that is misleading or suggests an endorsement beyond the Recognition actually awarded.

Website Use

The Website is provided for information about and participation in the Top 100 Leaders Program.

You must not use the Website:

  • for an unlawful purpose;
  • to provide deliberately false or misleading information;
  • to interfere with the operation or security of the Website;
  • to attempt unauthorised access to systems or information;
  • to transmit malicious software or harmful code; or
  • to conduct automated scraping, data extraction or reproduction of Website content without our written permission.

Website content may be updated or changed from time to time.

Third-Party Services and Links

The Website may contain links to third-party websites or use third-party platforms, including payment, hosting, email, analytics or technology providers.

Links or references to third parties do not necessarily constitute endorsement of those parties.

Top 100 Leaders is not responsible for the content, availability, security or privacy practices of third-party websites or platforms that are outside our reasonable control.

Privacy

Personal information collected through the Website and nomination process will be managed in accordance with the Top 100 Leaders Privacy Policy and Privacy Collection Notice.

Personal information may be collected about both the Nominator and Nominee.

Submission of a Nomination is subject to the Privacy Collection Notice presented during the nomination process.

Communications

Top 100 Leaders may contact Nominators and Nominees where reasonably necessary in connection with a Nomination or the Program.

Administrative communications relating directly to a Nomination or Recognition are not marketing communications.

Marketing communications will be managed in accordance with applicable law and our Privacy Policy, including applicable unsubscribe requirements.

Website Information and Disclaimer

Information on the Website is provided for general information purposes.

While reasonable care is taken when preparing Website material, Top 100 Leaders does not warrant that all information will always be complete, current or error-free.

Information published about recognised leaders may include information supplied by Nominators, Nominees or third parties.

Recognition should not be relied upon as professional, financial, legal, employment or investment advice.

Liability

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.

To the maximum extent permitted by law, Top 100 Leaders is not liable for indirect, incidental, special or consequential loss arising from participation in the Program or use of the Website.

To the extent permitted by law, where Top 100 Leaders' liability in connection with a Nomination cannot be excluded, its liability will be limited to the remedies permitted under applicable law.

Top 100 Leaders is not responsible for decisions made by employers, clients, industry participants or other third parties as a result of a person's Nomination, selection or non-selection.

Program Changes and Events Outside Our Control

Top 100 Leaders may make reasonable changes to Program dates, assessment processes, announcement dates or administrative arrangements where circumstances require.

If circumstances outside our reasonable control affect delivery of the Program, including technology failures, natural disasters, government action, widespread disruption or other events beyond our reasonable control, Top 100 Leaders may reasonably modify or postpone the affected aspect of the Program.

Where a material change directly affects a submitted Nomination, Top 100 Leaders will take reasonable steps to communicate that change.

Changes to These Terms

Top 100 Leaders may update these Terms from time to time.

The current version will be published on the Website.

A change made after a Nomination has been submitted will not retrospectively remove material rights associated with that Nomination unless the change is required by law or is reasonably necessary to protect the fairness or integrity of the Program.

General

If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed to the extent necessary without affecting the remaining provisions.

A failure by Top 100 Leaders to exercise a right under these Terms does not constitute a waiver of that right.

These Terms, together with the Privacy Policy, Privacy Collection Notice and any specific Program conditions published as part of the nomination process, constitute the terms governing participation in the Program.

Governing Law

These Terms are governed by the laws of Tasmania, Australia.

You and Top 100 Leaders submit to the jurisdiction of the courts of Tasmania and any courts having jurisdiction to hear appeals from those courts.
